司法権を行使する国の機関。日本では他の国家機関の干渉を受けず、独立して裁判をおこなうことになっている。日本国憲法によって設置される最高裁判所と、法律の定めるところによって設置される下級裁判所（高等裁判所、地方裁判所、家庭裁判所、簡易裁判所）とがある。他国のものには連邦裁判所、司法裁判所、行政裁判所、憲法裁判所、軍事裁判所などがある。
